DOE Approves Nuclear Fuel Cycle Consortium Under DPA

DOE approved a voluntary agreement creating the Nuclear Fuel Cycle Consortium under the Defense Production Act, granting antitrust protection for participating companies.

The Department of Energy approved a voluntary agreement that establishes the Nuclear Fuel Cycle Consortium under the Defense Production Act. The agreement was published in the Federal Register on July 6 after a public meeting and comment period and coordination with the Department of Justice and the Federal Trade Commission. The Defense Production Act framework provides antitrust immunity for specified collaborative activities by participating firms.

The consortium organizes committees by stage of the fuel cycle and extends across mining and milling, conversion, enrichment, fuel fabrication, deconversion, recycling and reprocessing, and the operational interfaces between fuel suppliers and reactors. Under DOE oversight, participating companies may share information and develop formal Plans of Action to address capacity gaps, timelines and technical constraints in those segments.

The published list of participants includes firms that operate across the nuclear value chain. Named companies include Cameco, Centrus Energy and Lightbridge; advanced reactor developers Oklo, NuScale Power and NANO Nuclear; reactor owner-operators Constellation Energy, Vistra and Talen Energy; supply and engineering firms BWX Technologies, Curtiss-Wright and Flowserve; and specialized suppliers Solstice Advanced Materials, Mirion Technologies and Amentum.

The participant list encompasses material suppliers, component manufacturers, construction and site services, instrumentation providers and waste management firms. The agreement allows those firms to coordinate schedules, identify capacity shortfalls and propose joint solutions for agreed activities without the usual antitrust constraints that apply to independent competitors.

Market indexes already include exposure to many consortium participants. The VettaFi Nuclear Renaissance Index, known by the ticker NUKZX, contains several of the listed companies and serves as the underlying index for the Range Nuclear Renaissance Index ETF (NUKZ).

Under the consortium framework, DOE will oversee collaborative activities while industry committees develop targeted Plans of Action for specific supply-chain segments. Those plans may focus on reducing project risk, aligning support for existing plants and coordinating timelines for new reactor deployment, and addressing technical or capacity issues raised by members. The agreement implements directions in executive orders aimed at strengthening the domestic nuclear industrial base and follows a declared national energy emergency.
